Welcome to Eunice’s Touch. These Terms of Service (the “Terms”) govern your access to and use of our website, online store, products, content, and related services (collectively, the “Services”). “Eunice’s Touch,” “we,” “us,” and “our” refer to Eunice’s Touch, located at 1200 Lake Saint Louis Blvd, Unit 322, Lake Saint Louis, MO 63367, United States.
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services. By visiting, interacting with, or using the Services, including making a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.
Please read these Terms carefully. They contain important provisions concerning warranty disclaimers, limitations of liability, and dispute-related rights.
1. Access and account
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. If you permit a minor dependent to use the Services through a device or account you own or manage, you are responsible for that use.
You may be asked to provide information such as your email address and billing, payment, and shipping details. You represent that the information you provide is accurate, current, and complete and that you have the right to provide it.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You may not sell, transfer, assign, or license your account to another person.
2. Our products
We make reasonable efforts to describe and display our products accurately. Colors, scale, texture, and appearance may vary based on your device, screen settings, lighting, and manufacturing variations. Measurements are approximate unless stated otherwise.
Product descriptions, pricing, availability, and specifications may be updated without notice. We may discontinue products or limit quantities by customer, household, geographic region, or jurisdiction. Product information is provided for general informational purposes and does not create a warranty beyond any warranty expressly stated in writing.
3. Orders
Placing an order is an offer to purchase. We may accept, decline, limit, or cancel an order for lawful reasons, including suspected fraud, pricing or inventory errors, payment issues, or product unavailability. An order is accepted only after payment is authorized and we send confirmation of acceptance or shipment.
Please review your order carefully before submitting it. Once tracking information has been issued, an order cannot be cancelled for a change of mind. Returns, exchanges, and refunds are governed exclusively by our Refund Policy: https://eunicestouch.com/policies/refund-policy.
If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided at checkout. Purchases are intended for personal or household use and may not be made for unauthorized commercial resale or export.
No subscriptions or recurring charges.
Eunice’s Touch does not offer subscription services or recurring billing. Each transaction is a one-time purchase. You will be charged only for the items and charges shown at checkout, with no automatic renewals or hidden recurring fees.
4. Prices and billing
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed at checkout when the order is placed. Unless expressly stated otherwise, displayed product prices exclude taxes, shipping, handling, customs duties, and import charges. All applicable charges will be presented before you complete the purchase.
Promotional terms may apply separately. If promotional terms conflict with these Terms, the promotional terms control for that promotion. Prices offered through third-party marketplaces or other sales channels may differ from prices on our website.
You agree to provide current, complete, and accurate purchase, payment, and account information. You represent that you are authorized to use the payment method submitted and agree to pay all charges shown at checkout, including applicable taxes and shipping charges. Eunice’s Touch does not add undisclosed merchant surcharges or hidden handling fees.
5. Shipping and delivery
Shipping and delivery dates are estimates, not guarantees. Delivery may be affected by carrier operations, weather, customs, address errors, or other events outside our reasonable control. Risk of loss and title pass as provided by applicable law and the shipping terms disclosed at checkout.
We are not responsible for delays caused solely by a carrier or by inaccurate delivery information supplied by the customer. We will, however, make reasonable efforts to help track an order and address documented delivery issues with the carrier. Customers must promptly review tracking updates and contact us if assistance is needed.
6. Intellectual property
The Services—including our trademarks, trade names, logos, text, graphics, photographs, videos, audio, reviews, page design, and arrangement of content—are owned by or licensed to Eunice’s Touch and are protected by intellectual property laws.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for personal, noncommercial purposes. Without our prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, sell, or exploit any portion of the Services except as permitted by law.
Eunice’s Touch names, logos, designs, and slogans are trademarks of Eunice’s Touch or its licensors. Shopify names and marks belong to Shopify. Other names and marks belong to their respective owners. No license to any mark is granted by implication.
7. Optional tools
The Services may provide access to tools offered by third parties. We do not monitor or control those tools and provide access to them “as is” and “as available,” without endorsement or warranties of any kind. Your use of an optional tool is at your own risk and is subject to the third party’s terms and privacy practices.
New features, tools, or resources added to the Services will also be subject to these Terms unless separate terms are presented.
8. Third-party links
The Services may contain links to or content from third-party websites. We do not control or guarantee the accuracy, availability, security, products, services, or practices of third parties. If you leave our Services or transact with a third party, you do so at your own risk and should review that party’s terms and policies.
To the fullest extent permitted by law, we are not liable for harm arising from third-party websites, content, products, or services. Questions or claims concerning a third party’s products or services should be directed to that third party.
9. Relationship with Shopify
Shopify provides the ecommerce platform that hosts our online store. Purchases made through our store are transactions directly between you and Eunice’s Touch, not Shopify. To the fullest extent permitted by law, Shopify and its affiliates are not responsible for the products we sell or for claims, losses, or damages arising from your transaction with Eunice’s Touch.
10. Privacy policy
Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy: https://eunicestouch.com/policies/privacy-policy. Because Shopify hosts the Services, Shopify also collects and processes certain information needed to provide and improve its platform. Shopify’s handling of personal information is governed by its own privacy policy. Information may be processed by service providers in countries other than the country where you reside, subject to applicable law.
11. Feedback
If you submit or post ideas, suggestions, reviews, photographs, comments, proposals, or other content relating to the Services (“Feedback”), you grant Eunice’s Touch a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, and otherwise exploit that Feedback for operating, improving, and promoting the Services, to the extent permitted by law.
You represent and warrant that:
- you own the Feedback or have all rights needed to submit it and grant this license;
- your Feedback is accurate to the best of your knowledge and does not violate any law or third-party right;
- you have disclosed any compensation, discount, free product, or other incentive connected to the Feedback; and
- your Feedback does not contain unlawful, abusive, defamatory, obscene, deceptive, or malicious content or code.
Unless required by law, we are not obligated to keep Feedback confidential, compensate you for it, or respond to it. We may monitor, edit, decline to publish, or remove Feedback that we reasonably believe violates these Terms or applicable law.
12. Errors, inaccuracies, and omissions
Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, shipping charges, delivery estimates, or availability. We may correct or update that information and, where permitted by law, cancel or modify an affected order. If we cancel a paid order, we will issue the appropriate refund.
13. Prohibited uses
You may use the Services only for lawful purposes. You may not use the Services to:
- violate any applicable law, regulation, ordinance, or third-party right;
- infringe intellectual property, privacy, publicity, or other proprietary rights;
- harass, abuse, threaten, defame, deceive, impersonate, or harm another person;
- submit false information, fraudulent orders, unauthorized payment details, or misleading reviews;
- transmit spam, phishing messages, malware, viruses, or other harmful code;
- scrape, crawl, harvest, collect, or track information except as permitted by law and our written authorization;
- circumvent security, access controls, technical restrictions, or measures designed to protect the Services; or
- interfere with, overload, reverse engineer, copy, resell, or exploit any part of the Services in an unauthorized manner.
We may suspend or terminate access when we reasonably believe a user has violated these Terms or created a risk of fraud, harm, or legal risk.
14. Termination
We may suspend or terminate your access to all or part of the Services, subject to applicable law, if you violate these Terms, misuse the Services, or create a security, fraud, or legal risk. You remain responsible for amounts properly due before termination.
Provisions that by their nature should survive termination will remain effective, including those concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, severability, assignment, governing law, and accrued payment obligations.
15. Disclaimer of warranties
The Services and information made available through them are provided for general informational purposes. While we aim to provide accurate and useful information, we do not warrant that all content will always be complete, current, or error-free.
TO THE FULLEST EXTENT PERMITTED BY LAW, EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY WE PROVIDE, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
Some jurisdictions do not allow certain warranty exclusions. Nothing in these Terms excludes or limits a warranty, consumer guarantee, or other right that cannot lawfully be excluded or limited.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EUNICE’S TOUCH AND ITS AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, BUSINESS INTERRUPTION, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM A PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.
These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other nonwaivable obligations.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Eunice’s Touch, Shopify, and their respective affiliates, owners, directors, officers, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising from your material breach of these Terms, violation of law or third-party rights, or unlawful misuse of the Services.
We will provide reasonable notice of an indemnifiable claim. A delay in notice will relieve you of your obligations only to the extent the delay materially prejudices your defense. We may participate in or control the defense with counsel of our choosing, and you will reasonably cooperate. We will not agree to a settlement imposing nonmonetary obligations on you without your consent, which will not be unreasonably withheld.
18. Severability
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.
19. Waiver; entire agreement
A failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with policies and operating rules posted on the Services and incorporated by reference, constitute the entire agreement between you and Eunice’s Touch concerning the Services and supersede prior or contemporaneous communications and agreements on that subject.
Any ambiguity in these Terms will be interpreted fairly and will not automatically be construed against the drafting party.
20. Assignment
You may not assign, transfer, or delegate these Terms or your rights or obligations under them without our prior written consent. We may assign or transfer these Terms and our rights or obligations in connection with a merger, acquisition, sale of assets, reorganization, service-provider arrangement, or other lawful business transaction, subject to applicable law.
21. Governing law
These Terms and any separate agreement through which we provide Services are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Subject to any rights you may have under applicable consumer law, you and Eunice’s Touch consent to the personal jurisdiction and venue of the state and federal courts located in Missouri for disputes arising from or relating to the Services or these Terms.

Headings are included for convenience only and do not limit or otherwise affect the meaning of these Terms.
23. Changes to these Terms
You may review the current version of these Terms on this page at any time. We may update these Terms by posting a revised version to the Services. When required by law, we will provide additional notice of material changes. Revised Terms become effective on the date stated in the notice or posted version. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms, except where applicable law requires another form of consent.
